General Terms and Conditions
1. Scope of Application
These General Terms and Conditions (GTC) apply to all services provided by Casaventa in the areas of real estate consulting, real estate marketing, real estate appraisals, presentation packages, sales documentation, photo, video, and drone footage, 360° tours, interior harmonization, financing support, and coordination with specialized partners.
2. Closing the Contract
A contract is formed upon acceptance of a quotation, written confirmation of an order, or any other written agreement.
3. Scope of Services
The scope of services is determined by the relevant quotation or written agreement. Additional services will be charged separately, subject to prior written agreement.
4. Prices and Terms of Payment
The agreed prices shall apply. Unless otherwise agreed, invoices are payable in full within 30 days of the invoice date.
5. Presentation Packages
Presentation packages may be purchased independently of a sales mandate. If Casaventa is subsequently appointed under an exclusive sales mandate, the cost of the selected presentation package will be credited in accordance with the written agreement.
6. Property Valuations
Property valuations represent a professional assessment of the market value at the time of valuation. They do not constitute a guarantee of the sale price ultimately achieved.
7. Client Cooperation Obligations
Clients shall provide all information and documents required for the fulfilment of the assignment completely and truthfully.
8. Intellectual Property Rights
Unless otherwise agreed in writing, photographs, videos, drone footage, floor plans, documentation, visualisations, texts and concepts remain the intellectual property of Casaventa or the respective authors.
9. Liability
Casaventa shall be liable only for damage caused intentionally or through gross negligence, to the extent permitted by law. No liability is accepted for information provided by third parties.
10. Data Protection
Personal data is processed in accordance with Casaventa’s Privacy Policy and applicable Swiss data protection laws.
11. Place of Jurisdiction
Swiss law shall apply. For consumers (B2C), the mandatory statutory provisions governing jurisdiction shall apply. In all other cases, Casaventa’s registered office shall be the place of jurisdiction, to the extent permitted by law.
